eBay stole €3,800 from me
Summary: geofcanna0 explains that they bought three iPhones via eBay, but returned the items to get a different version. However, eBay withheld a refund of 3,800 euros on the grounds of fraud and closed their account. Despite a refund being confirmed by the seller, the money is blocked in the eBay account. Several participants suggest documenting the interactions to clarify the situation or contacting the FEVAD mediator, which geofcanna0 did.
Hello everyone,
I suppose I’m not the first or the last to experience this situation. I placed an order for three iPhones from the seller "As Good as New" for a total of €3746. The models were iPhone 14 Pro Max with 256 GB of storage. After receiving the three phones, I realized that I needed the 512 GB version because of frequent iCloud storage issues. As a result, I sent the phones back to exchange them for 512 GB models.
"As Good as New" confirmed receipt of my items and informed me that the refund was being processed, so I could place the order again. However, that was when eBay refused to process the €3800 refund, claiming that I had fraudulently used the return process. In addition, they closed my account.
More than five months have now passed without anyone replying to me. As a result, I am going to take legal action, because it is unthinkable for me to lose €3746 online.
I am calling on any witnesses to contact me so that I can build a strong case with the help of my lawyer. Thank you.

Take the problem the other way around ,
You made a payment by credit card ,
This card is automatically covered by insurance ,
You make an appointment with your banker armed with proof ,

Just a lead to recover the funds blocked at eBay, since all the elements you provide seem to prove it...
- Contact the FEVAD Mediator... You can find his contact details on the web... Explain your whole problem clearly and chronologically. (you may finally get a positive result, they have helped other eBayers who also had abusive fund withholding...)
Best regards

·2 years agoHello, @geofcanna0
I don't understand your story. Rereading all of your posts, it seems to me that you bought and paid for an "item", (3 items), then sent it back to the seller for personal reasons, and the seller refunded you, and you bought a second "item" (3 items) from them. And I don't understand what you're claiming because I'm missing some details
.For the first sale, you didn't lose anything since you were refunded. The seller got their items back, but if they refunded you without having touched the amount you had set aside, they are the one at a loss.
You don't say whether the second sale took place. It would be interesting to know that in order to properly assess what happened.
Best regards.

OP2 years agoHello @nareio
Let me clarify the situation. There was only one order of 3 phones. After returning the items, the company [Pseudo] issued the refund on their side. However, since the initial payment was made on eBay’s site, and eBay closed my account, it seems that eBay decided to hold the funds.
I just received a reply from [Pseudo] support, which confirms that on their side, the refund was processed. However, I am currently dealing with the issue of the money being held by eBay, which is causing me a real problem.

OP2 years agoHello,
Here is the reason I still don’t understand:
Your account does not comply with our Policy on inappropriate buyer behavior. Buyers may not abuse the rating system, the return process, or our buyer protection programs.

·2 years agoGood evening @geofcanna0
Here is the reason I still don't understand:
A possible fairly simple scenario:
1)You opened a chargeback request with your bank
2) for X reasons, your bank rejected this request
3) According to the outcome of this rejection, Ebay most likely judged that you violated a rule and decided to close your account.
best regards
geofcanna0
OP2 years agoHello @felin12,
I want to point out that when you entrust your money to eBay to make online purchases, you do not expect your money to be held without a valid explanation. Next time, I will seriously consider buying in a physical store, because the practice of holding both the consumer’s money and the purchased products is, to me, unacceptable.
Even though my chargeback request through my bank was rejected for X reasons, I think it is right and fair that eBay, as an online sales platform, do everything possible to resolve this problem. Keeping both the products and the consumer’s money is a practice I have never seen in my life, and I am sure you will understand my frustration with this situation.

·2 years agoHello everyone
@geofcanna0
My point was about the possible reasons for an account suspension
and not the transaction itself.
Besides, since apparently everything unfolded well
- return request accepted and confirmed by the seller
- request for a refund from the seller to eBay.
were your steps taken as part of a dispute or via eBay messaging or privately?
Because it is hard to figure out where the snag came from
and in the course of events, at what point did you open a chargeback?
Since you have a lawyer, it seems to me that they are best placed to advise you on the steps to take to get your money back.
kind regards

·2 years agoHello @geofcanna0
If I understood correctly what surprised me, you contacted the seller directly, who reimbursed you directly, all without going through e-bay, then you claimed your payment from e-bay so you could finish what you were considering as an exchange? And when they refused, you went to your bank? Well... the rest doesn't really surprise me... it amounts to being reimbursed twice for the same item... and if you explained it like that to the other three parties (e-bay, the seller, and the bank...) they must have done like me and asked themselves questions.... But maybe I still keep misunderstanding ????
If I were you, I would start by contacting the seller to consider a joint approach, after a mutual explanation as calmly as possible.
And then follow @lingma85's advice. (hi!!!)
Best regards.

·2 years agoHello, hello. @geofcanna0
Now I understand better. You wanted to speed up the process by sending “the item” straight back to the seller.Unfortunate move. The result is that you blocked the process and turned a protective measure into a measure of suspicion and rejection.A machine does not think. It applies a program.FIRST RULE :YOU DO NOT TAKE INITIATIVE WITH A MACHINE. YOU FOLLOW THE PROGRAM. (here: carry out the return. For it, you still have the item and, on top of that, you want the money...Oh, how nasty....Come on, shoo, out you go...)
To understand better, let's take an example with a simple machine, say a soda vending machine. You have in your pocket one euro, a sample token given by your plumber and the lucky gold louis given by your Aunt Arsinoe. You are mistaken But, louis or token, for it, it's the same thing :not good, fraudster.
.So, it spits it out, or else it blocks, depending on the dimensions of the “fake” coin.I'll let you imagine what happens next, depending on the case,( and it can go a long way depending on the state of the vending machine if you've been kicking it to get the auntie's louis back...).No more gold coin, and on top of that, you've become a delinquent.
SECOND RULE :YOU DO NOT ARGUE WITH A MACHINE. We wait until the programmed delay in its brainlessness has passed before moving on to the next phase of its program (return, dispute, cancellation....or human contact, depending on the case).
I am sorry for you.But you must agree that it wasn't very clear. and that is the THIRD RULE :WHEN YOU GET HUMAN CONTACT, YOU PREPARE YOUR INTERVENTION.
Sincerely.

OP2 years agoThank you for your detailed message and your advice on how to interact with automated systems. I really appreciate your help in understanding the process but how can this help me get my money back or at the very least my products?
Kind regards
nareio
·2 years agoWell, then....follow the advice of @lingma85 and @felin12 , and mine: first contact your seller to make this request for intervention jointly and especially clearly so as to show your good faith . And don't hesitate to say what you did wrong.
As for me, just a regular user of this platform (and others), I don't know any more than that. I can only hope that it will help others.....
Best regards.

what I see is that for that price you could have found out what you were buying first, and then eBay isn't amaguiz and returns for personal convenience
it was up to your seller to deal with you, no need to drag the site into your mistakes
geofcanna0
OP2 years agoI agree with you on the form. I made a mistake regarding the storage capacity. However, it is important to note that the law governing e-commerce provides a 14-day return period, which is actually common practice in the industry, and that is precisely eBay's area of business. In response to your previous message, I would like to inform you that I have resolved the issue internally with "As Good As New", which issued the refund upon receipt of the products. However, it appears that the transaction was blocked by eBayPay, Ebay's in-house payment provider, and that they decided to withhold my corresponding €3800.
