Cancellation refused
Summary: durnacos says they asked to cancel a purchase on eBay shortly after making it, but their request was denied because the time limit was supposedly exceeded. Frustrated by the situation, durnacos is considering legal action and help from a consumer rights association to resolve the dispute. Several participants point out that the process may not succeed, emphasizing the proper cancellation procedure by the seller and accountability for buying mistakes. The discussion also includes advice on handling cancellations and common errors on the platform. Other participants share similar experiences and discuss the potential issues with the eBay process.
A few days later I received a refusal from eBay stating a refusal because the deadline had passed.
I forwarded the case to my lawyer because the deadline was met. I do not understand.
I will also contact a consumer association to obtain a favorable outcome
.I find this abusive.
Kind regards

·2 years agoHello @didge.fr.bvhiqk45
The instructions are here----> Cancel an order as a buyer | eBay
If the seller refuses, you still have the option to pay, receive it, and return it...
but since it's an error on your part, the return shipping costs will be your responsibility.. (as with any purchase made on the internet regardless of the platform..)
Regards
PS
I forgot...
For returns, it's here------> Return information (for buyers) | eBay

·2 years agoHello @durnacos
When you challenge a cancellation refusal by arguing that you had done what was necessary within the 5 minutes following the purchase...
BUT ... while leaving out the main point which is described here by the site--->
"If you want to cancel an order, you must contact the seller and ask whether they can cancel it for you. The seller may accept or refuse your cancellation request."
Cancel an order as a buyer | eBay
So it would seem that ----> there is a refusal on the seller's part, as they are entitled to do....
and there is no possible challenge in such a case (you won't find a lawyer with two cents of common sense who will take your side... because losing a case is not good for their reputation...)
The late timing argument given by eBay is only an accessory to this possibility.
To conclude this transaction,..... you need to pay, receive it and send it back if the item does not suit you... That's the only solution that fits this case...
Kind regards

·2 years agoHello,
it would have been so much easier to think before buying rather than after.
But mistakes are always possible, but blaming others for it
and threatening to go to a lawyer, consumer associations, and why not the court
when all you have to do, as frlonvert says, is not pay
and the best part is that the seller won't even be able to leave you a negative review
Avoid bothering all these people who surely have much more important and urgent cases than yours

do you really have nothing better to do than hire a lawyer for an uncertain request
no one can force you to pay, so forget it, only your seller is penalized by your carelessness

it's because of litigious people that the justice system is overwhelmed and no longer has time to deal with real cases
give things the importance they actually have

I canceled within 5 minutes of the purchase.

I’m not playing eBay’s defense team here , but sometimes the cancellation you send doesn’t “go through” , same for people clicking to place a bid 10 seconds before an auction ends
for it to work, it will still be necessary to prove that the site did indeed receive your cancellation within the required time, and your legal protection will have a hard time with that
as for providing a solution to someone who can’t read a listing or understand what they’re buying, sorry, I’ll take responsibility for that!

when you cancel, it's important to check that it's really cancelled

·2 years agoHello, @durnacos .
If what you say is accurate, I understand that you could be in a bad mood. However, as @frelonverre told you, nothing obliges you to pay for this purchase and the dispute is between you and e-bay and comes down to possible penalties. In this story, the seller seems to be in the clear and, in the end, the only one to suffer the consequences by delaying his sale.
Experience has taught us that this kind of problem can have different sources, for example a time zone problem, a bad browser clock setting, a robot bug, an error in the procedure, a mistake by e-bay services.....etc. As volunteer participants in this forum, we do not have access to this data, and we have to take your word for it. Experience has also taught us that, even with people acting in good faith, things are sometimes more complicated than they seem.
Since you are lucky enough to have the services of a law firm at your disposal, which is not the case for most of the site's customers, don't forget to let us know what resulted from it.
Sincerely.

·2 years agohello @nareio , we've already seen plenty of these, since the site doesn't communicate about court decisions we won't know anything about it
as for @durnacos if he keeps insisting between the fact that a complaint may not be admissible and the fact that he lost nothing in this story , I don't see what he'll come tell us
the soufflé will collapse on its own , happy new year
