NEGATIVE AND DEFAMATORY REVIEW
Summary: lamodejurassienne2013 expressed frustration after selling a handbag on eBay, followed by a series of complications with the buyer requesting a return and leaving a negative, defamatory review. Other participants, such as *miss-tigri*, suggested contacting customer service, while frelonverre downplayed the impact of the seller rating’s temporary drop. red71-2011 and tytan-d2-71 were more critical, questioning lamodejurassienne2013’s business practices. The discussion took a tense turn, and one participant ultimately decided to close the thread because of the tone of the exchanges.
Hello
I sold a handbag whose description clearly stated in red and bold that there was a problem with the flashing lights, which I could NOT check since the bag has an old-style charging cable like Samsung (the bag is from 2017) and I have APPLE equipment... There was 20% off automatically and I also stated that there would be NO RETURN since I made that clear. The buyer pressured me to send the bag immediately even though my terms say 10 days: I did it right away; as soon as he received the bag he asked for a return, of course citing another reason in his dispute... I accepted the return (to keep the peace), he forced me to send him a return label claiming there was a small unreported scratch... I sent him a Colis Privé label for pickup at a relay point because I am not at home: I sent this label on December 19 and then no more news... on the 23rd I asked him where things stood and on the 24th I received a dispute from eBay saying that they had settled and that the buyer had to send the bag back to me and that to do so they had sent a Colissimo label to the buyer even though, I remind you, I am not there for the postman's visit... On the 30th, the postman came and naturally did not find me; I called my neighbor to pick it up on the 31st, which he did and then (even though I was not able to check the condition of the bag on its return) I received a message from eBay saying that they had refunded the buyer in my name while also taking my commission refund away from me... I opened a request to explain that I am not at home and therefore cannot check the item and then: here we go again, the buyer who must have been notified (but was nevertheless fully refunded) leaves me a negative review with a defamatory comment! Yesterday, I kindly asked him to make a gesture for the holidays and change his comment and then he added insult to injury by posting photos of a bag that does not correspond to the one I sold and, on top of that, he wrote me ANOTHER insulting message directly to my email address WITHOUT GOING THROUGH EBAY MESSAGING: here is the copy:

How can I get eBay to take responsibility and protect me as a pro seller as should be the case; I wrote to them BUT a robot replies to me (basically): "that buyers have all the rights and that it will stay that way and that no, these are not defamatory remarks"
It’s the only negative comment, except that it brings my rating down from 100% to 94.4%... and maybe I attach too much importance to it but I am 72 years old and my sales are my only income so it’s worrying me...!
I know I’m writing to members but if by chance this message could be read by a REAL eBay employee: I ask them to do something for me so that my reputation is not tarnished!
Thank you for reading me

Hello everyone and happy new year,
I think you're the only person here doing everything possible to tarnish your reputation despite your many arguments and details to put down your buyer.
I did a little research on the internet since, it seems, according to the information you provided on your many listings in your shop, you're a professional seller...
Information such as:
Your names and addresses, email, phone number and company VAT number.
Let's be clear, I'm accusing no one of anything. Anyone can do this research with the information YOU gave.
But I'm curious to know why the Siren number you provide corresponds to a business that is marked as dissolved since 2017 on the INSEE website and the Société point com website?
If I had any doubt about your business and about yourself, I would be tempted to think that you're selling under the table with a fake company number, but fortunately, I could be wrong.
Or else you made a mistake with your own Siren number. Anything is possible.

it's good to look up info on a seller, but it's less admirable to "call him out" on a public forum, you should have sent it to him in a private message
whether this seller bends the rules is none of your business
no need to sic the mob on him, enough with the pile-on

That’s what VAT number information is for, so anyone can verify it at any time.
She basically outed herself by making this post.

well, you see, none of the other speakers checked this, you're the only one
what does it matter whether she's a professional or a private individual, what matters is her integrity toward the buyers
tytan-d2-71
·1 year agoOh really? And how do you know that? You're talking nonsense.
And what does it matter to you if I check her information and ask her for more details about it?
She comes onto the forum to trash her buyer, which in itself is just demagoguery, and apparently we should say nothing or think nothing about her own mistakes?
This topic is a call for testimonies, and I'm testifying, whether you like it or not!
And you're probably a paragon of virtue, telling others what they should do when you yourself are throwing me a bone to distract the crowd, like in many of your posts where you don't hesitate to go after people when what they say or do doesn't suit you!
Clean up your own backyard, sir!
She presents herself as a professional seller and now, proving I hit the mark, she's changed her VAT number. I don't know what's worse, selling as a pro with a fake number or selling as a pro with a number that doesn't exist!
Maybe we should ask a moderator in the end, as another participant suggested?!!!
Oh yes, what a great idea!
That would put an end to this charade, this hypocrisy!

And you, what does it matter to you that I check his information and ask him for more details about it?
personally I couldn't give a damn about what you check, check whatever you want, and from the start I told you that you should have handled that detail by DM
She comes to the forum to trash her buyer
she vented her anger but is trashing no one since the buyer's username isn't mentioned and is encrypted in the review
And you're probably a paragon of virtue
I'm far from being the model you mention, but I just can't stand the "snitches" , I can't stand informersMaybe we should ask a moderator in the end like another poster suggested?!!! But yes, what a great idea!
go ahead, you're on the right track

" I sold a handbag... with flashing lights... an old-style charging cable like Samsung (the bag dates from 2017) and I have APPLE equipment..."
You are the first and only person responsible for the listings you post on Ebay, and if the item is damaged or still sealed, it’s up to you to tell your future buyers. You’re supposed to know the condition of what you’re selling.
" NO RETURNS since I said so."
You’re a pro seller, you can’t refuse the return. You’d have to look in the commercial code to find all the articles that mention it, but you can’t refuse the return.
" The buyer put pressure on me to send the bag immediately even though my terms say 10 days: I did it right away "
If shipping is listed as within 10 days, you have to stick to your deadlines. The customer is not king.
Selling is the goal, but selling at any cost... well, it’s up to you whether or not to respect your own rules...
" barely had he received the bag ... of course mentioning another reason in his dispute..."
As I understand it, you were expecting another reason? That’s not clear!
" I’m not at home: I sent this form on December 19... On the 30th, the postman came and of course didn’t find me... on the 31st"
You’re a pro seller and you don’t warn your customers about an absence of more than 24 hours from your online shop on the platform... Did you think Ebay would take care of it for you?
" leaves me a negative review with a defamatory comment! "
I think you’re confusing " defamatory " with " insulting or abusive "
Defamatory " means stating A FACT that harms a person’s honor or reputation "
Public insult would be more appropriate, but honestly, filing a complaint with the public prosecutor would cost you at least 2500 euros in filing fees... Not sure it’s worth it...
Especially if you have a low income.
" photos of a bag that doesn’t match the one I sold "
It’s your word against his; we can’t really know unless we have a copy of your listing. You still have access to it for 90 days. It would be enough to slip in a screenshot copy of it so we could check for ourselves. Otherwise, it’s very suggestive and completely impossible to verify.
" he writes to me WITHOUT GOING THROUGH EBAY MESSAGING "
That’s his right. There’s no obligation to use eBay messaging.
UNLESS I’M WRONG on that
" another insulting message... "
Ah, you see, insulting and defamatory, you’re mixing them up...
"I know I’m writing to members "
Fantastic, very few people know that... don’t tell anyone
" but if by chance this message could be read by a REAL eBay employee "
Actually, we could report your post to a moderator who, after reading it, would tell you the best course of action to get other answers.
That’s the only way I know for a follow-up that’s a little more favorable than our modest answers as simple eBay members...
Kisses and happy new year! 😘

the percentage that went down will only stay for a year and all sellers have encountered this kind of issue at least once, it’s not a big deal, reply to their rating in carefully chosen words to explain your opinion
