I’m looking for people to support a complaint against Ebay.
I started filing an online pre-complaint for the following reasons:
This has happened several times now: I sell items on ebay, the buyers pay, and once they’ve picked up the goods they trigger a procedure to get refunded. I don’t know how they do it, but despite the tracking showing that the buyer was delivered the item, Ebay ends up sending me messages like this “
Therefore, you owe the amount of 37.00 EUR to eBay. We will recover this amount from your account. ”
How is it possible, even though Ebay knows the item was indeed delivered, that they can take the money from my sales back without my consent? Ebay is responsible for payment security as well as verifying those payments, since it happens on their platform. If there is a security flaw in their payment system, that is their responsibility.
By what authority can Ebay employees (under the responsibility of SASU Ebay France SIRET 43277810800030) decide to recover the amount of a sale even though all documents indicate that the item was delivered.

There's no point in trying to resolve a problem without going through the site's tools (private messages for example ..)

it’s a matter of principle. If everyone pays and rolls over, they
will keep operating the same way. They need to understand that their

I sold a new Delta and the buyer claims it’s broken, so Ebay is refusing my dispute because The dispute has been closed, as we have been informed that the buyer had opened a payment-related dispute with their payment institution. this is how to get paid quickly and easily for a Delta Dore. You have a broken Delta Dore, you go on Ebay, find a seller, place an order, when the package arrives at your place you take out your old Delta Dore, take a few photos and report that the seller delivered you a defective Delta Dore and that’s it, Ebay closes the sale in the seller’s disfavor

- Regarding your question, file a complaint against eBay!
- Unfortunately you are registered there as a private individual.
- you benefit from the advantages of a private account on eBay, and take advantage of them across several accounts. Apparently! Judging by your replies on this subject.
- you sell a lot on ebay items of defense weapons, new, and mentioned with no returns!
- With no professional mention on your listings. « private listings »
- Except there aren’t many like you, who come to complain on this eBay community forum about filing a complaint against ebay. And for whatever reason.
You must be in compliance at a minimum to file a complaint.
- One piece of advice before posting on this forum :
- ask your lawyer whether your complaint would be plausible!, or file a complaint at the gendarmerie with your file and your ebay pseudonym account « s » and, or tax advisor.
- rest assured you are not the only one on eBay!
- because eBay’s policy is that the seller who writes a listing is solely responsible for these sales.
- on each eBay listing like yours, we cannot report it.
-Example : report a listing /inappropriate seller conditions/ and there, only one option is offered to you.
‘Early sale’
So the report is abandoned. There are no other options to check.
- so one more piece of advice, put yourself in order on ebay and on your current listings before considering any kind of legal action.
Please note that this is my last comment. On this post I will no longer insist.

Save this entire post, go see a legal advisor and provide them with your ebay accounts and ask them the question. End of story.

Be aware that the sale of this kind of items is regulated and subject to declaration, and I am not convinced that you are making sure to comply with the regulations in force in this country.
If I were you, I would not come to a forum to complain when I myself am in complete violation of the law.
Moreover, you say, " that they could take the money from my sales back from me without my consent."
Be aware that you signed a SEPA mandate, and that as a result, eBay has absolutely no need for your approval to withdraw any amount it deems useful to withdraw from you.

As I already said, in my case, on the commercial side I don’t see the mistake, it was Ebay that validated the payment, so they’re the ones who need to take care of payment security, it was through ebay ( with the Packlink provider) that I shipped, precisely so that everything would go through Ebay and there wouldn’t be any suspicion of some shady trickery I would have done by not delivering the buyer, so from my side I really don’t see any reason why ebay could justify taking the money back, rather than the fact that since they handled the payment they should be responsible. But of course you’re so brave that you may not agree with me.
On the other hand maybe because of my ignorance ( I’m not very sharp apparently!!) is it forbidden to have a personal account if you own one or more companies whether in the service sector or commerce or industry or crafts ? If there is no obligation, why make that remark to me.
To finish: to take up your terms

So it doesn’t bother you at all that at Ebay, if they want to unfairly recover money they can do so under the pretext that I signed a SEPA and that therefore ebay has absolutely no need for my agreement to debit amounts they deem unfairly useful to debit from me. The SEPA transfer must not be used for that purpose, because based on a bad judgment ( since they are not judges) that would amount to embezzlement. ( that’s very good for my defense). Do you see yourself as an Ebay spokesperson, because if that’s the case your words suit me, if that’s not the case I don’t see why you’re talking to me about all this because the main issue is indeed the fact that Ebay judges and takes back money so they are responsible for the loss due to a fault in payment.
And of course I hope that your sentence " while I myself am totally in violation of the law" only speaks for you, because if you are referring to me I see nothing but defamation.
In any case I opened this post to find help and good advice for or against Ebay, but I can see that instead some discussions are turning to what I may have done wrong and not to what Ebay may have done wrong.
I see as a consequence, surely intended, a good wrecking of the topic to muddy the waters !!

You don't seem to want to understand it (whether deliberately or not ...), but you have a professional activity while you are registered as an individual. In fact, your complaint against eBay will never succeed since you are yourself in an illegal situation.
Some participants just warned you about this.

I’m going to answer your first question.
1/ here is the eBay policy regarding your first question:
"Professional sellers are required to comply with all official regulations, including registering as a professional seller on eBay, providing contact details and return conditions.
An eBay seller must register as a professional seller if, for example, they sell items they bought to resell, they make items to sell, or they buy items for their business activity"
Which is your case here.
If, as you say, you have a Siret number outside of online sales, that means you are a professional, and as such you are violating the policy and the current law by registering as a private individual on the site.
In addition, as a professional, you are required to create return conditions, which you do not do on your listings, given that you state "the seller refuses returns," a statement which I must point out has no validity on eBay.
You must then comply with all official regulations and requirements, including:
Informing buyers that they have a 14-day withdrawal period for items covered by consumer contract legislation. no mention made on your listings, because with a Siret number as you say, you are a professional.
Here too, you are in violation.
Basically, you say you have a Siret number, you buy items to resell them, and you register as a private individual, so yes, you are in violation.
In addition, none of your listings comply with the law.
Your account on eBay, and your listings, have only one purpose: to bypass the legal and financial constraints that you clearly have outside the internet.
Regarding the debits made on your account by eBay, these are perfectly legal.
You gave your consent by electronically signing a SEPA mandate, and therefore these debits were made with your agreement.
You say that eBay is judge and jury, and that is the case, just as it is the case with PayPal, which judges and makes decisions, **bleep**, etc ...
If eBay believes that the buyer has been cheated, then eBay will take back the product from the sale and refund the buyer. here too you accepted the site’s terms and conditions and as such, you are fully informed of the consequences in the event of disputes.

Thank you for your reply, which seems clear to me. I think you have the link to what you wrote; could you give it to me, because I don't think it's just these few lines. That would show me whether these are writings from a ".gouv" or from "eBay", because it's not at all the same thing: one shows a regulation, the other an eBay-specific rule. If it doesn't come from a ".gouv", then I take your message more as intimidation than as information or help.
I had specified in one of the posts that even though returns were not accepted, the buyer was refunded. You are right, that mention has no value and thank you for pointing it out (at least it doesn't only come from me), eBay should remove it or warn private sellers that in the end it has no value.
I am very familiar with the SEPA Mandate system, this setup dates back quite a few years now, but I doubt it was put in place to allow money to be withdrawn at the discretion of the company that received it.
That is why, in my case (as you say eBay can decide whether or not to withdraw), eBay allowed itself to do so without carrying out a serious investigation, to find out whether I was at fault or not.
Just to remind you, in my case I sent a product, the product was received so it was delivered against an identity document or security code, with proof of posting and delivery provided to eBay as requested, and eBay, as you say, nevertheless decided that the buyer had been deceived. (Again, I ask whether you are a spokesperson for eBay and whether you receive any benefit or payment for replying to me.)
So it is this judgment, with no possible recourse and above all with no attention or consideration of any evidence, that I want to have condemned. This has happened to me several times, and I don't think I was the only one this has happened to, so that is why I now want to multiply the appeals on as many platforms as possible against these eBay practices, hoping that I will not be attacked as much here.
I looked at the other listings selling the same item as me and others that I do not sell, such as batons, and I am surprised that there are so many online, that there are so many private sellers and professionals selling them, and moreover some of them are sponsored. I would not have thought that sellers pay to sell this kind of product. So eBay takes money for this kind of item without needing any sales to happen, I can't believe it.

Individuals who carry out services on an occasional basis are not required to declare them. Indeed, according to the provisions of Article L. 121-1 of the Commercial Code, « those who carry out acts of commerce and make them their habitual profession are traders ».
If you make purchases of goods with the aim of reselling them on the internet, you become a professional seller, states this same article of the Commercial Code.
Such a qualification is all the more likely if you are seeking to derive profits from this activity.

I just saw that on your message there is the possibility to say that it’s useful, but I don’t see the possibility to say that it’s useless, it’s like as a seller you can’t leave a bad rating when you have a problem with a buyer, too bad because in the end you can’t really rely on the ratings.

So I was on one account and I wanted to go to this forum to find help, I logged in with the chosen account, I wrote what I had to write and after validation even though I was logged into the account I had chosen ( I checked by opening another window and going to hello Laurent at the top left that I was still on my other account) the validation still went to the other account, probably because of the cookies " damn cookies"

Honestly your post isn't very useful for me or for Ebay so it would still have been more pointless to say " I'm not saying anything" but hey I understand you, I'm not very sharp myself either!!!

francexpressdeal you're absolutely right to clarify my accounts, at first I didn't see the point but in the end there is one since this problem didn't happen on just one account. On the other hand I can see that you have access to my personal information, yet the last times I dealt with Ebay outside of this forum it was, how can I put it!! Confirmed or clarified, I don't know how to describe the action, that they couldn't see the link with my other accounts, because I had mentioned a problem with a client and I was told (like koalagris wrote earlier) that I had mixed everything up between my accounts and that they couldn't deal with this problem because there was no access to the other accounts for confidentiality reasons.
When I asked the question " I don't understand the problem, why am I not compliant" it was to get a real answer, not " Extraordinary " (it's weird I couldn't put your smiley, I got a red-background message saying "You don't have permission to upload images." why am I not allowed and you are?)
For your curiosity yes I know URSSAF, every 3 months but that's exactly why I'm not looking for advice about URSAF so for me your answer isn't useful and in the end I don't understand why you're replying to this post. Unless you're Ebay's spokesperson, but that doesn't help me and in the end this kind of reply isn't really the best for Ebay's image. As I said above, is it really mandatory to open a professional account on Ebay if you own companies? Your comment could have been relevant, but I can smell the jealous person claiming that private sellers aren't beneficial to his business, though I hope I'm wrong, that's not very glorious behavior!!
That said, my point also applies to the other people who, rather than helping me or saying nothing, make assumptions about the flaws my stores on Ebay might have; once again I see deliberate post-trolling more than anything else. This rather highlights an attitude of collaboration with Ebay rather than real help or advice, put another way we could have said that these were tips given in case I wasn't compliant. But that is not the case right now.

- Who sells only new products and self-defense items.
- Stated in the listings, no returns !!!! complete nonsense!
(no REP number to provide). Sales in Germany possible because there is no Lucid number. !!!!!
- What does eBay do! Nothing! It takes the money. And has for a long time because it warns you on every listing written.
- Because eBay simply tells you that you are fully responsible for your sales.
- And that it disclaims itself from any problem related to your activity. Clear or not clear.

Ebay does not prohibit having multiple personal accounts or both business and personal accounts. If you have a company or several.
On a personal account, you must not list items related to your business.
It's not Ebay you need to fear but the DGCCRF.
(Do some research online about your obligations as a business and the risks for a business registered under your own name).

If the refund made by Ebay is under the diktat of a charge back or retro-billing, (read Ebay's terms and conditions for this case)
Aside from filing a complaint against the buyer himself, (not much else to do)

Thank you for your reply. But we’re still talking about what I am or am not, and not really about the main topic. But still, you’re telling me to look at eBay’s T&Cs about the fact that even if a product is delivered, eBay can recover the money to give it back to the buyer. Do you think they put that in there so they wouldn’t have to justify themselves before taking the money back? That kind of behavior still sucks; doesn’t it raise any ethical issues for them?
On the other hand, you’re telling me that on a personal account you can’t carry out a professional activity, very interesting info, thanks, because I stayed with a personal account to limit the extra monthly fees and because the benefits of a pro account weren’t necessary. Are you sure I can’t keep my personal account?

No! you cannot carry out a professional activity with a personal account
As a professional, you have obligations that are not compatible with a personal account

You are absolutely right, I make a lot of mistakes in general and a lot of typos too (uncooperative keyboard) I try to correct them as best I can, but yesterday I had to जवाब to a lot of people as quickly as possible in order to waste as little time as possible. I’m sorry that it bothers you that I make spelling mistakes, and it’s a shame that you are more bothered by my spelling than by the fact that on several occasions I have had payments taken away from me. It’s true, spelling is so important.

For each sentence beginning, capitalization is essential, and full stops at the end of sentences are nice too, but your spellchecker apparently doesn’t take that into account. But is that really important.

·3 years agoI missed the part about the fraud office and the URSAF, what's the point of saying that and who is it meant for? Honestly, I have an accountant for the URSAF, so I don't really ask myself too many questions; on the other hand, the fraud office, that's a good idea you gave me, I hadn't thought of that. In short, do you have any advice on how I should go about contacting them, is it better to write to them or call them? Can we go there in person?

Be careful, the complaint must be against unknown persons. If you file a complaint directly against eBay, they can sue you for defamation. On my side I filed a complaint against unknown persons (criminal procedure) and I’m going to take them to court (civil action).
Are the amounts of your sales less than €500? If so, tracking is enough; if it’s more, you need an acknowledgement of receipt.
If you want to ask them for more details, you can make a report on signal.conso.gouv.fr. They read the reports every Tuesday and respond within 72 hours.

The total amount is less than 500 euros. What are the tracking or acknowledgment of receipt used for, to send what and where?
What is signal.conso.gouv.fr for? You say if I want to ask for more details I can do so, but asking for details to defend myself or to discuss it with Ebay.
You talk about taking legal action, do you have to do it when filing the complaint or is it extra?

·3 years agoTo put it simply, it's the fraud enforcement platform. This website lets you report eBay to the fraud authorities. eBay then replies to explain why they took such action against you, why they ruled the dispute in the buyer's favor. When you have a disagreement with a company, it's always a good idea to do it. because the fraud authorities can hassle them if the number of complaints becomes too high.
Here are the explanations for taking legal action: https://www.service-public.fr/particuliers/vosdroits/F35603. Basically, you take them directly to court. On the other hand, you'd better know eBay's terms and conditions inside out and be ready to absorb the attacks they will have prepared against you. And it can take time, so you have to judge whether it's necessary.
If I was asking about the amounts, it's because for a sale whose amount is over €500, to prove delivery you must have a receipt acknowledgment, but in your case that's not the case, so that doesn't explain eBay ruling the disputes against you. Report them on the fraud enforcement website, they'll explain why they're doing that!
