RSGP, no need to provide information if there is no information from the manufacturer
Summary: casimirdts shares concerns about the GPSR regulations, saying that eBay is not clear about the requirements for second-hand products. francexpressdeal clarifies that only certain exceptions apply to products placed on the market before December 13, 2024, in compliance with a specific directive. Discussions then follow about the complexity and potential impact of this regulation on sales, including exchanges about other platforms. Several participants express frustration with eBay's enforcement of this directive, while others share their strategies for complying with the new rules.
Hi, just a quick note, I confirm that nobody knows anything about this GPSR regulation, not even eBay is able to answer my simple questions.
After going through the explanatory description of this GPSR available on eBay, the only info clearly stated explains that: for a used product for which we have no information about the manufacturer and so on, we do not need to provide the information required by the GPSR in our listings. So for me, who sells vintage antique items, I’m going to apply that, because it’s impossible to have precise data on the origin (address, phone numbers of the manufacturers, and other details.
Hoping this can help pro sellers like me

·1 year agoHello, I received a message from eBay today telling me that my listings are not compliant and that I need to update them according to the GDPR, without being able to tell me which listings are concerned (I have about 900).
My items are used and were sold before the end of 2024, so I thought they were exempt, I'm having a hard time understanding.

·1 year agoHello,
Thanks for your message. I’m totally lost as well. For products sold before December 2024, we’re not affected, but it’s impossible to enter even an approximate manufacturing date for the product so as not to have the listing hidden.
So I’m still pretty worried! Will my listings stay visible, how will they decide whether to hide a listing or not?
I’m going to ask for a callback Monday morning, but I remain skeptical about the implementation and the checks, which seem random to me.

·1 year agoHello , I also sell second-hand furniture and items, but ebay tells me they will delete my listings if I don't provide any information, what did you put and where? (I can't find it), because when I buy an unsigned Scandinavian table, I don't know the provenance and the names and contact details of everyone I bought it from.
It's getting really complicated EBAY
thanks for your help

·2 years agoHello,
I have a probably stupid question about this new regulation! With my other account ( pro ) when I create a listing I see this:
So, with my very own logic ( which doesn’t amount to much ), should I understand that IF I do NOT send my items to the EU or the United Kingdom ( one wonders why they’re concerned since there was Brexit, but anyway that’s another story ) and I VOLUNTARILY LIMIT myself to mainland France, I could get around this damn RSGP ?!?
Once again, please forgive the potential stupidity of my question ... as Mr. DUSSE said, "on a misunderstanding" ... it might work 😉
Have a good day ... and good luck!

" I’m VOLUNTARILY limiting myself to metropolitan France, could I get around this piece of crap RSGP?!?"
unfortunately no... the French buyers being based in the EU.

·2 years agoHi there!
"unfortunately not... French buyers being well located in the EU."
Alas (times 3 or more if you like!) that's sadly true @francexpressdeal, but I thought (or wanted to think, no doubt) that the wording of their sentence left a loophole I would have eagerly jumped through with barely concealed delight 😉
I checked the blog by "jules-de-chez-smith-en-face" (I'm not a seller there) and it seems that the anxiety about this regulation is just as present there as here! Maybe even more so! I didn't look into the other places. Le coincoin seems, on the other hand, not to be mentioned anywhere on the subject for the moment. Hence my question about sales in France ONLY!
It's going to be carnage ............
Have a good day!

another certain major international site (I don't have the right to name it, but it starts with the letter A 😉) has put certain measures related to the RSGP in place since the beginning of 2024.
It's very interesting to go on their forum and see the questions asked there, but especially the customer service replies (because on this site, customer service gets involved... 🙄)
So yes, I confirm it's an absolute mess!
Have a good day as well.

·2 years agoHi!
"a certain other big international site (I'm not allowed to name it, but it starts with the letter A 😉)"
@francexpressdeal is the site I call "jules-from-smith-opposite" and for which I looked up some kind of blog, I think. I'll check whether it's a forum (like here) and the answers provided by their customer service!
Well then, off I go! See you next time!!!

·2 years agoI’d be curious to know how many listings they’ll skip if they apply their logic even to categories where the rule doesn’t apply, like old books or antique porcelain
We’re probably looking at a good 50%+ and, honestly, it’s mostly going to hurt them because all that merchandise lost on their site will end up on others that are less inclined to apply the rule blindly without taking the time to see whether the item for sale actually matches this regulation or not
You’re going to have a huge pile of products in categories that don’t match what’s being sold
The antiques category is going to be flooded, that’s for sure, and good luck to eBay sorting through it

·2 years agoHello @casimirdts
you need to refer to this eBay help page:
https://www.ebay.fr/espacevendeurs/ressources/legislation-reglementation/rsgp?mkevt=1&mkpid=2&emsid=e99011.m2.l1&mkcid=27&bu=43158809803&osub=b45e27bfabe90318bcaa925aef995bcc%257EFR_T&segname=1725372047435MCFR_T_FR_T&crd=20240911020000&ch=osgood
So what you are saying only applies to "used products supplied for the first time on the EU market before 13 December 2024 and compliant with the General Product Safety Directive (2001/95/EG)."
Note that article 51 in fact applies to ALL products put up for sale before 13 December 2024 (new or used): "according to article 51 of the GPSR, products supplied for the first time on the EU market before 13 December 2024 and compliant with the General Product Safety Directive (2001/95/EG) may continue to be sold without the GPSR-required information having been added to their listings."
Now, since it is clearly stated that these items must be "compliant with the General Product Safety Directive (2001/95/EG)" and since eBay has established a list excluding certain categories, it is a safe bet that as of 13 December, items not on this list will suffer divine punishment whether or not they are covered by article 51.
Article 51 can only be applied on a case-by-case basis, but the sorting will no doubt be done by a devilish AI that will rely solely on this exclusion list...
As you said: "e bay is unable to answer my simple questions.", so trying to justify it by invoking article 51 seems pointless to me...
In the case of new regulations, the problem is always the same: on one side there are the legal texts and on the other the interpretation of that same law by sales sites. With EPR, we have already seen how that turned out, so we should not expect miracles with the GPSR...
casimirdts
OP2 years agoWhat happened to REP? Were the listings suspended or deleted for those who weren’t up to date with this REP? For new items that were supposed to have information concerning ‘the packaging principle’ or risk deletion, a pro friend has many listings in “new” that he left for sale and his listings are still present on the site even though he didn’t enter the required ‘packaging’ number (another regulation made in Europe.)
francexpressdeal
·2 years ago@casimirdts
you are registered as a pro on the site, so you are also concerned by the REP. In fact, you should know very well what happened.
That said, your initial post was about the RSGP. The point of my reply was to make you understand that you communicated incorrect information.
So here, we are off topic. If you want to "talk" about the REP, it would be more appropriate to open a new post.

·2 years agohello ,
it's true that when you see some titles you're surprised we’re still at this in 2024 , I guess ebay is causing confusion about what a forum is, otherwise we wouldn’t have people starting a thread titled something like " yamasuzuk tz27 garde-boue av " ??
on the other hand I don’t think casimirdts is entirely off-topic on his own thread , since to discuss ebay’s reactions to the appearance of a new standard , it makes sense to take the previous ones into account .
that said , what you’re saying is crystal clear , thanks : all products on the market before December 13 are exempt .
francexpressdeal
·2 years agoHello @rosedebretagne
"that being said, what you are saying is crystal clear, thank you: all products on the market before December 13 are exempt."
That is not at all what I said. Quite the opposite.
To try to be clearer:
Article 51 is as follows: "Article 51 - Transitional provision - Member States shall not impede the placing on the market of products covered by Directive 2001/95/EC that comply with that directive and that were placed on the market before 13 December 2024."
Yet proving the compliance of an item under Directive 2001/95/EC amounts to pretty much the same thing as what we are being asked to apply for the directive that will apply on December 13, 2024.
