Package marked "delivered" but lost

I’m in a bit of a tricky situation. I was expecting a package for January 17. My partner was at home, and I got a delivery notification, great! When I got home in the evening, nothing in the mailbox, and my partner hadn’t received anything in person. I checked with my neighbors: same result.
I opened a case with the post office, which is investigating. In the meantime, I found my mail carrier’s number. We exchanged SMS messages, and she told me that no delivery took place on January 17 because of freezing rain.
Meanwhile, I contacted the seller, who claims the package was delivered. So, I opened a claim on eBay. eBay is siding with the seller, because the status on the post office website says: "Delivery of your package has been confirmed as part of the investigation of a claim case".
And yet, the package is definitely lost, because the post office sent me several emails confirming that it was lost.
So, to recap:
- I did not receive my package.
- The post office tells me to go to eBay.
- eBay tells me to go to the post office.
- The seller gets paid by eBay, and on top of that, he gets reimbursed by the post office. He also calls me a liar, to boot.
What can I do to get a refund? I find it a shame that eBay stops at the delivery "status" indicated by the post office, and I also find it a shame that the post office marks a package as delivered when that was not the case at all...

unfortunately, if the parcel is marked as delivered and certified by the post office, there's nothing that can be done.
E bay sticks to the delivery details confirmed by the post office, and the seller does too.

OP2 years agoThanks for your reply, yes, on the postal service website it says delivered, but under weird circumstances... I had never seen the mention "Delivery of your parcel has been confirmed as part of the investigation of a claim file". Then the post office tells me to file a complaint against Ebay and Ebay tells me to file a complaint against the post office. For €130 I don’t think it’s worth the energy and time it would take to get that money back... I’m disgusted by Ebay’s terms and conditions, which don’t really investigate in the end, anyway I’ve lost, all I can do now is count on my bank for a chargeback, but I don’t believe in that either, have a good day!
