How do I report a shipping scam?

I ordered two items on eBay from the seller [PSEUDO]
I wanted to pay for my order by asking the seller to send me the total taking into account combined shipping costs, but that option was impossible,
so I asked the seller how to proceed and the seller replied: «Hello, I know. Please order and I’ll refund you afterwards.».
So I had to pay 38 USD in shipping costs when ordering, even though they were actually 5.19 euros (shipping from France to France).
Unfortunately, since that day, the seller has been playing for time by promising me a refund that never arrives!, then stopped replying to me!
I still haven’t received the excess I paid for these exorbitant shipping costs that the seller had nevertheless promised to refund just before I ordered the 2 items from him.
The seller’s lies and bad faith from the start show that this is a scam on the sale price, with the seller applying exorbitant shipping costs to inflate his sale prices.
I can’t find anywhere on eBay a way to open a dispute that matches this scam and request reimbursement of the overcharged shipping costs.
I do not want to return the 2 items I bought, but for the seller to immediately process the refund of the actual shipping costs against those paid.
How do I deal with the seller’s obvious bad faith?

is a scammer, but too late...
Hence my question How do you deal with the seller’s obvious bad faith?
Impossible to open a dispute with eBay’s current dispute system.
That opens up great prospects for theft and scams for sellers who know that we get no help from eBay and no recourse against these shipping fee scams...

By confirming the purchase through payment, you accepted the shipping fee amount.
You should have canceled the purchase and redone it with the correct amount.
No dispute possible on eBay, except to request a return, but the shipping costs will be at your expense.
