If I understand correctly, I get delivered **bleep**, I have to waste my time a sending it back at my own expense otherwise I won't be reimbursed for the scam I'm currently being subjected to. eBay in no way feels responsible for the thieves and scammers who use the site to make easy money
Obviously the item has to be sent back, because otherwise every buyer (lying or not) reporting a counterfeit could keep their purchase ...
At one time, returning it wasn’t mandatory if you provided a certificate proving the non-conformity after an expert assessment requested by you.. See what the customer service says about it...

You can say whatever you want.... and/or whether you want to or not....
- if you want to be refunded for your purchase... you’ll have to go through returning your purchase... Return an item for a refund | eBay
Otherwise, you keep it...
