The buyer was refunded but did not return the item
Summary: estschi_13 sold a watch on eBay to a German buyer, who then disputed the authenticity of the strap and the watch. After proposing a compromise and agreeing to a return, eBay refunded the buyer without the watch being returned. Despite several attempts to get in touch, the item was not sent back. francexpressdeal suggests contesting eBay's decision, but estschi_13 says they already tried without success, expressing frustration that eBay closed the dispute without resolving it.
Hello, about a month and a half ago I sold a watch on eBay to a private German buyer.
I was leaving on vacation at that time and I came back about 2 weeks later.
He received the watch a few days after it was sent. I didn’t check my messages since I was on vacation.
So I got back home, and I saw that he had sent me a message a few days before I returned, saying that the bracelet wasn’t original.
I apologized for the late reply, and told him that the watch bracelet was presented and sold as is, in the photos as well as in the description.
No response.
A few days later, he opens a dispute saying that the watch bracelet wasn’t original.
So I offered through the dispute tab a refund of €80 so he could buy an "original" bracelet if it really bothered him that much.
No response.
After that, he sends another message through the dispute tab, saying that the bracelet AND the watch are not original (change of tune now?) and wants to return it.
A return I accept while saying that if he didn’t like the watch, he shouldn’t have opened a dispute over ONE BRACELET.
So I accept the dispute, and try to get a return label and provide it to him. Impossible, I try to do this on Mondial Relay, Colissimo, La Poste, as well as on eBay, impossible, as a private seller, I can’t buy a label by pretending to be the buyer, and put it in his name.
So I tell him by message this time, that I can’t get a label in my name, and politely ask him to try to get one on his side/via eBay.
Still no response
2-3 later, the buyer gets eBay involved, which rules in his favor and refunds him in full.
Except that the package has not been sent back.
I followed up at least 4 or 5 times asking the buyer to send the watch back, and I got no response.
So he stole my watch and got the amount refunded (€700).
Obviously I tried to report him, sent emails to eBay, and I got no response.
What can be done about this problem? Because I’d like to either get my watch back or get my money back.
Thank you.

OP1 year agoGood evening again, I had already disputed eBay's decision because the watch had not been sent back. But they didn't take it into account and closed the dispute anyway... I can't file another dispute

you had just specified "Obviously I tried to report it, sent emails to eBay, I got no response."
So if you already disputed eBay's decision and that didn't lead anywhere, on the site there isn't anything else to do. At least to my knowledge, so wait for the opinions of other contributors.

OP1 year agothanks anyway for your intervention,
eBay is still being dishonest in this story.
I don't understand the site's action, refunding the buyer without the seller's opinion or even the item's return
