I bought an item that turned out not to match the description: very worn even though it was listed as new, no label even though it is a branded garment (I don't know if it is counterfeit). I made a return request which was accepted by the seller. Then the seller says he can't send me the return label and tells me that according to Ebay it's up to me to buy it. I replied that Ebay tells me the opposite: the return label remains the seller's responsibility if the item does not match the description. The seller opens a dispute that was decided in my favor a few days later. I therefore received a full refund before returning the item. I would also like to point out that the seller has a strange and unpleasant attitude from the start: he ignores most of my messages, and when he does reply, there is neither hello nor goodbye. After receiving the item, I asked several times why the item has no label and whether he has any other proof of authenticity such as a purchase invoice, for example. All these messages have been left unanswered and I suspect that he is a dishonest seller (he also has another negative review mentioning a similar experience). The question is, should I still send the item back if a) I have already received the refund and b) he never sent me the return label or offered other ways to cover the return shipping costs?

OP2 years agoI finally called Ebay customer service to find out what I should do. Here's their response, in case it's useful to anyone: I don't have to return the item at my own expense. The seller has already been informed by Ebay that the return shipping costs are their responsibility. If they don't want to listen, too bad for them.

And no one told you otherwise. What you were told is that since your seller is in the United Kingdom, they cannot issue you a return label.
So you will have to pay for the return upfront. This amount will be reimbursed to you later.

OP2 years agoI don't understand why you're misleading me. Ebay explicitly tells me that I don't have to pay these fees upfront and that I won't be reimbursed by Ebay if the seller refuses, which is the case.

You have a deadline to return your purchase .... if it has passed, you will not be able to claim a refund because eBay is strict about deadlines....
BUT given that the dialogue seems to be deadlocked.... that you are right ... that the seller is sticking to this position, the choice is simple...
- Either you choose to send the goods back with payment of the shipping costs.... and then you will be refunded your +/-300 € purchase... but you may lose +/- 20 € in shipping...
- or you keep digging in your heels and lose your +/- 300 € but you don't spend the +/- 20 e in shipping...
It's up to you to decide where your interest lies...

Of course I have.... on the other side of the Atlantic... but the payment was in the local currency for the supplier... the supplier doesn't want €, only the currency of his country interests them.... it's the same for Royal Mail..
But if you gave your Paypal address... maybe your seller would put in a few £ to pay the shipping costs.

You’ve already done some damage...
- your seller is in the United Kingdom and therefore he cannot send you a return slip since the currency (payment) is different and French post does not accept £...
- you complain that there is no label.... it says so in the listing...
- as for the return, it is obvious that it will be your conscience that will dictate your conduct... It’s an expensive garment ( listed at +/- €300 ) - you’ve been refunded...
Therefore, you must send it back to your seller otherwise, this could amount to embezzlement... or unjust enrichment, or theft.... (call it what you like..) ---> although some might tell you to keep it since eBay is not asking you to return it (at least, apparently)... !
See with La Poste whether you can use a Colissimo with cash on delivery for international shipments..
Since you’ve already given him a hard time with plenty of explanations... it seems to me that you were right to come....

- the solution for the seller in this case would have been to offer to cover these fees in another way, but not to lie to me by saying it was up to me to buy my own shipping label. Besides, I’m really not convinced that it’s actually impossible for the seller to pay for the label; purchases in other currencies are perfectly doable.
- please, show me where it says that the garment doesn’t have the brand tag, I’m very interested
- I don’t understand why I have to return the item at my own expense to the dishonest seller who ignored my messages and tried to scam me several times if it’s up to him to pay for them

- try the test of going to the Post Office and asking for an international Colissimo in £.... and you’ll understand that this isn’t doable... The other way around, it’s the same.

OP2 years ago- What does that have to do with it? The seller doesn’t have to pay La Poste in pounds in cash. Foreign credit cards are accepted everywhere, and the conversion to € would happen without him having to do anything. Have you never shopped on foreign websites or paid outside the eurozone with your French card?
- I’m not talking about that tag there (paper). The problem is that the skirt has no label (fabric) that could identify the brand. I have no way of knowing whether it’s an authentic garment. In addition, that’s not the only problem, the garment is worn, the elastic is very stretched out, it was dishonest to list it as "new never worn".

You can inquire about the cost of a return and tell the seller that the skirt is available and will be sent back to them upon payment of this amount or, as lingma suggests, with reimbursement if that option is available for the United Kingdom ....
