Dispute with the buyer
Summary: lachineusedenormandie sold a camera on eBay, specifying that it was sold as-is and untested. The buyer found that the camera didn’t work and suggested a partial refund. francois-o explained that in cases of non-conformity, the seller must accept the return and refund the buyer, unless the listing clearly states that the item is non-functional. koalagris and francexpressdeal pointed out that the mention ‘untested’ does not indicate whether the item works and suggested making listing descriptions clearer to avoid misunderstandings.
I sold a camera and clearly stated in the listing that I was selling it as-is and untested.
The buyer asked me questions about the camera, namely whether certain things worked or not, but since I don’t know much about it, I told him that yes, what he asked about seemed to work, but that I wasn’t 100% sure.
The buyer decides to buy it, and sends me a message today saying that unfortunately the camera doesn’t work.
And that he would like an amicable arrangement, meaning to split the difference for the refund.
But for me, I’m not at fault because I clearly specified in the listing that the camera was sold as-is.
What should I do? Wait for the buyer to open a dispute and hope eBay will rule in my favor, or reply to his proposal?
Thanks for your feedback
Regards

Good evening @lachineusedenormandie ,
I'm sorry to hear that you're having a bad experience with a buyer on eBay.
If the buyer states that the item arrived damaged or that it does not match the listing description, then you are obliged to accept the return. (Return shipping costs are the seller's responsibility in this situation.).
Once the item is received, you will have 2 business days to issue the refund.
If your listing clearly states that the item does not work, then your return policy applies.
Here, it is up to you to decide whether a partial refund is preferable to a return, because if the listing does not explicitly state that the item does not work, then eBay will rule in the buyer's favor.
I invite you to contact me on our social networks: Facebook/Instagram/Twitter
I can then look into all of this in more detail 🙂. And tell you how eBay can step in.
Otherwise, you can contact customer service. To do this, go to the bottom of our help page and click on => Contact us.
Choose the option that suits you best and an agent will call you .

It’s the condition recorded in the listing that counts (sold on another account? we can’t see anything on the one you’re posting from):
https://www.ebay.fr/help/selling/listings/creating-managing-listings/item-conditions-category?id=4765&st=3&pos=1&query=%C3%89tats%20des%20objets%20par%20cat%C3%A9gorie&intent=etat&lucenceai=lucenceai&docId=HELP1421#section3
“not tested” in the description has no value because it doesn’t say whether it works or not.

you’re likely to have the same problem again because on some of your listings it says:
And in your description:
An item clearly can’t be advertised as "fully operational and working properly" and then "sold as is - NOT TESTED"
You should update your listings accordingly.
