non-compliance with the advertising announcement
Summary: derol_8881 expressed dissatisfaction about a delivered vacuum accessory that does not match the advertised description. They are asking eBay to cover the return shipping costs and refund the order. francexpressdeal and francois-o clarify how eBay works as a platform, explaining that individual sellers are responsible and that a dispute can be opened to handle the issue. lingma85 advises derol_8881 to review the site's terms and conditions to better understand the responsibilities of the parties involved.

Hello, the vacuum cleaner accessory delivered does not match your advertisement. _1 hose is shorter, 1.6 m instead of 2 m, 2_ the diameter of the nozzle on the accessory connection side is 34.5 mm whereas the bore of the accessories is 35.5 mm _ so there is play and the accessories are not held securely and there is air leakage. 3_ the outside diameter of the hose is 39 mm whereas the one I have is 45 mm, hence a loss of flow.
For this non-compliance in every respect, I ask you to cover the return shipping costs of the parcel and provide me with a suitable return label as well as a refund. The return notice you gave me on your site states that the return shipping costs are my responsibility, which I do not accept.
Kind regards
francois-o
Hello @derol_8881 ,
I'm sorry to read that you're having a bad experience with a purchase made on eBay.
eBay is a platform that connects buyers and sellers. All items are sold by individual sellers on the eBay site.
If the item you received does not match the description in the listing, then you can open a return dispute under our guarantee.
The seller will then need to provide you with a way to send the item back. Otherwise, you can ask eBay to step in.
Here is the link to our help page on this topic: https://www.ebay.fr/help/buying/returns-items-not-received-refunds-buyers/renvoyer-un-objet-pour-obtenir-un-remboursement?id=4041&st=3&pos=1&query=Renvoyer%20un%20objet%20pour%20obtenir%20un%20remboursement&intent=retour&lucenceai=lucenceai&docId=HELP1134
From this page, click on the relevant item to open the dispute.
Otherwise, you can contact customer service. To do this, go to the bottom of our help page and click on => Contact us.
Choose the option that suits you best and an agent will call you 🙂.

Mentor3 years agoHello @derol_8881
you need to tell that to your seller:
https://www.ebay.fr/help/buying/resolving-issues-sellers/contacter-un-vendeur?id=4021&st=3&pos=3&query=Contacter%20un%20vendeur&intent=contactez&lucenceai=lucenceai&docId=HELP1051
Since he's in Poland, he won't be able to issue you a return label. So you'll need to pay the return shipping costs upfront.

OP3 years agoI’d like to remind you that the contractual order was placed with EBAY. It is
indeed EBAY that received the payment. EBAY must assume these
responsibilities since it accepted this type of sale from its supplier on
its website. My contact is therefore EBAY.
There is no question of the customer getting in touch with
EBAY’s supplier.
The refund and the handling of return shipping costs are EBAY’s responsibility.
If I have to advance the return shipping costs, EBAY must state it
clearly, either €16.5 plus €10 return shipping, for example, upon receipt of the
returned parcel.
Looking forward to more information from you.
Kind regards.

Your message from 12:12
It would seem that your "idea" of the relationships between buyer/seller/ eBay... is totally mistaken, and it would be good for you to seriously look into the site’s Terms of Use before spouting nonsense that could backfire on you....->
eBay.fr Terms of Use | eBay and in particular the paragraph that deals with how customer/seller relationships work and... the site. (see "conditions de mises en vente")...
This will help you understand a lot of things, provided you have mastered the basics of legal concepts that you refer to... and which require knowing, at the very least, the status and responsibilities of the people involved.
