Item not as described and refunded by eBay - what should I do with the item?
Summary: chb57220 received an item that did not match the listing and was refunded by eBay after contacting the seller with no response. eBay said he could keep the item, but the seller could request a return. koalagris suggested that the seller’s silence means he can do what he wants with the item.

I received an item that didn’t match the listing, I contacted the seller: no response.
I started a return process: no response in 3 days.
So I contacted eBay, who refunded me in full.
But what should I do with the item now? eBay told me I could keep it since the seller hadn’t replied... but the eBay rep added that the seller could ask me to send it back (paying the shipping costs). Well then, what do I do?
It’s now been 7 days since I was refunded and the thing is still sitting at my place...
After how long can I use it, give it away, or throw it out?

The seller's silence since the dispute was opened proves that he would rather let you keep the item than pay return shipping (otherwise he would have already made himself known): so you can dispose of it.
