Item marked as delivered but not true

I ordered a CD in China that was sent with eBay delivery service (La Poste in France) and the package was marked as delivered to my mailbox on December 10, 2024, but there was nothing in my mailbox.
I contacted the seller right away and then customer service, who reassured me that I was "protected by eBay service" and to ask the neighbors.
I asked all my neighbors, a small co-ownership of 14 apartments, but no one had it in their mailbox and the seller kept telling me to ask the delivery person in France because he couldn't do anything, but that's false as confirmed by La Poste and the eBay agents on the phone, according to whom the seller had to open a claim.
Today I got the response that my dispute was closed in the seller's favor, so I have neither the money nor the item I was supposed to give to a dear friend for Christmas.
I appealed this decision and in less than 24 hours it was rejected and closed in the seller's favor, so I contacted eBay customer service again by phone, which gave me the bad news and spoke to me badly and then stopped answering me while keeping me on the phone.
I am really disappointed and astonished by this behavior from support and there isn't even any objective proof that my package was actually delivered since there was no signature-on-delivery option.
I contacted my lawyer friend who advised me to file a complaint, but I don't want it to come to that.
To finish, I was treated like a liar by eBay, a customer since 2006 with only positive ratings (buyer/seller), so I decided to delete all my items for sale on this platform.
I received nothing and eBay treated me like a thief, I find that dishonest and not up to the standards of good support.
Has anyone experienced the same thing as me, please?

A partir du moment où le transporteur acte de la livraison ni ebay ni le vendeur ne prendront en compte votre réclamation, ça devient alors un problème entre vous et le transporteur uniquement.
Avez-vous sollicité ce dernier ? demandé une enquête ? Que vous a répondu La Poste à ce sujet ? (le destinataire peut parfaitement ouvrir une réclamation)

OP1 year agoOui, j'ai ouvert une réclamation, mais ils m'ont dit que surtout l'expéditeur peut faire quelque chose et que je dois attendre et s'ils trouvent le motif de cet erreur, c'est l'expéditeur qui sera remboursé, pas moi, car c'est lui qui a envoyé lobjet, pas moi.
Donc, la réponse de ebay n'a aucun sens car la poste, qu'on connaît bien avec les erreurs et les colis disparus, peut dire ce qu'elle veut et ce comportement de ebay n'est pas professionel du tout, surtout quand ses opérateurs même m'ont dit au téléphone que seulement l'expéditeur pouvait faire quelque chose, mais après ils ont clôturé mon litige en faveur du vendeur car le suivi dit que le colis a été livré dans ma boîte aux lettres (faux !).
Soit clair, je ne mets pas en doute que le colis a été envoyé par le vendeur, mais qu'il n'est jamais arrivé chez moi est simplement une certitude.
Pour terminer, si c'est vrai ce que vous dites, alors ebay devrait bien souligner que leur assistance exclu ce type de problematiques au lieu de dire au téléphone "pas d'inquiétude, vous êtes protégé et le vendeur doit ouvrir une réclamation" ou cela va être que du bla bla bla et souligne une manque de sérieux de leur côté, sans considerer le comportement pas professionel eu par le dernière opérateur au téléphone.
