Pair of wheels not compliant with the listing returned never refunded

Hello, I would like to report a dishonest German company (I have 4 pages of contact with this company with no response) - I ordered for my son a pair of front/rear wheels for an Aprilia RS 1998 for a total of €1,015 including shipping. The listing was false, so my son received wheel rims that did not match the listing. I informed the company and was asked to send back both parcels, looking for the cheapest carrier. I chose UPS, and the company immediately reimbursed the return shipping costs to my Paypal account. The two parcels were delivered on December 21, 2023. EBay did not help me since I did not know that I had to contact them, I contacted Paypal who also did nothing to help me (I have UPS proof that both parcels were indeed received by Motorize) - I filed a complaint with the German Embassy in Paris, which acknowledged my claim and also gave me other addresses to get things moving. So I am also going to hire a lawyer and ask for a refund as well as penalties for the days and months of waiting. I am surprised that a company, for €1,015, would rather be held up to scrutiny and lose credibility with all bikers (my son and my daughter-in-law are part of a biker club that travels throughout Europe during their holidays and will not be giving them any publicity) - I would have understood if I had been told that there had been a failure on the part of the professionals working in this company and that the refund was delayed, but here there is no news.

you had 30 days after the delivery date to open a dispute for a non-compliant item.
You contacted e Bay, you say that you were told that the listing had been corrected, before or after your purchase?
Listings can be viewed at any time and, at best, just before buying.
At present, the deadline on e Bay has passed.

OP2 years agoHello, Yes the listing was corrected by this company after it stated that the wheel rims received did not match what had been mentioned in the listing, and it was eBay that alerted me by telling me that I still had access to the original listing. This company is taking advantage of my old age not to refund the €1,015. Why did they rush to send me the amount of the return shipping costs for the two parcels to my Paypal account and why, since they have received the parcels sent back by UPS since December 21, 2023, are they not refunding me? I can understand, and that is what I wrote to them, that they are a little late in making the refund, but since then I have had no more response to my refund requests. So for me this company is not honest. Since I had paid by Paypal I contacted Paypal, who sent me an email telling me that they were reviewing my dispute file, but as I had not seen that they were asking me for other documents (which I had: proof of receipt for the 2 parcels), Paypal did not try to understand the case and the dispute was immediately closed. Since then I have been calling Paypal and each time a advisor tells me that he will take care of it, when that is not the case. I contacted eBay but since I opened a dispute with Paypal, the eBay site cannot take over this case. I am going round in circles. 1000 is the amount of my pension, so for me it is a significant sum and I do not dare tell my son that I was not refunded. I have just contacted the German Embassy in France so that it can help me get reimbursed by this company; I was given a website to contact a manager in Germany who can help me and possibly get a lawyer involved. I have 4 pages of written correspondence on eBay where I ask the company to refund me. No reply has been given to me to date.
