Intra-community VAT and micro-entrepreneurship
Summary: morguiquenart is having trouble with eBay, which requires an intra-EU VAT number to sell in Germany. Although she is exempt from VAT under her micro-entrepreneur status, she is trying to understand whether additional fees will apply. francois-o advises her to update her information on eBay and offers support via social media. morguiquenart has received conflicting information and is worried about the tax implications of her European sales exceeding €10,000 excluding VAT, mentioning the obligation to pay VAT beyond that threshold. lingma85 recommends consulting a tax inspector directly to clarify the situation.
Hello,
I am a micro-entrepreneur and eBay is asking me for an intra-community VAT number so I can keep selling in Germany. I’d like to know concretely whether I’ll have to pay VAT on my sales in Germany, since I’m exempt because of my status. If that’s the case, I’d rather give up selling in Germany. I contacted eBay, which always answers with no real answer and tells me to consult my tax advisor (which I don’t have), and the tax office simply tells me that I am VAT-exempt and that I just need to note on invoices :'VAT exemption, article ter 262 of the CGI'
Is anyone in the same situation as me and did they have to pay VAT in Germany despite their status?
Kind regards

Mentor2 years agoHello @morguiquenart
Ask the tax inspector who handles professionals in your sector for an intra-Community VAT number. Don’t make the request on a bogus website.. this does not imply paying VAT, nor, by the way, reclaiming it, since you are on an A.E....

Mentor2 years agoHello,
So, what’s the result ????
francois-o
Hello @morguiquenart ,
I'm sorry to read that you're having a bad experience on eBay.
I confirm that with auto/micro entrepreneur status, you are exempt from VAT.
Since the red banner on your account is asking you to update your information by providing your intra-community number.
With your status, enter your first and last name in the VAT field. That should complete the verification.
You can contact me directly on our social networks: Facebook/Twitter/Instagram.
I could look into this with you and send a manual verification request for your information if necessary.
Best regards
François

OP2 years agoThank you for your response. I am relieved to finally have the
answer to the question I have been asking eBay and the tax authorities for several
weeks, without getting an exact answer to my question.
I asked the tax authorities for an intra-Community VAT number and as soon as I
have it, I will go add it to my eBay account
Thank you very much

OP2 years agoHello François,
Since my cry for help on the ebay forum regarding the intra-community VAT number for micro-entrepreneurs on ebay (exceeding €10,000 in annual sales but not exceeding the micro-entrepreneur threshold exempt from VAT), I’ve received several messages from people who are completely lost, and here’s what Bob just sent me today:
'Hi Nathalie,
So, I have news about intra-community VAT.
I contacted a "Public Finance Inspector - National VAT B2C Center "OSS/IOSS" and the verdict is that :
If you sell more than 10,000 euros excl. VAT/year in European Community countries, it is mandatory to pay VAT in each of these countries, regardless of the social regime. AND to make things easier for us, a one-stop shop (OSS) is available on which it is possible to make declarations and payments.
Niiice.
Best regards,
Bob
QUESTION:
You replied to me on 24/11/2023
'I confirm that with auto/micro entrepreneur status, you are exempt from VAT. '
Help! I’m lost because I haven’t declared any VAT for Germany and the other countries?
Best regards
Nathalie

Mentor2 years agoGood evening @morguiquenart
I’ll repeat what I wrote to you above... namely--->
- meet with your Tax Inspector (he’s not going to eat you... he can only give you good advice to help you avoid having problems with the tax office later..) .
Information/guidance is also part of their job, and they are generally available to the public...
Since you are selling outside France, you do indeed need this number (and above all, do not look for it on the internet because you could be misled..)...
and as for declaring your sales.. see the Inspector = that will also save you future problems...
The VAT exemption is valid below the turnover thresholds given to you... Once you go over those thresholds, you become liable.
Best regards

OP2 years agoThe problem is that I wrote to the tax office and their reply was anything but
clear and often completely off the mark, but I'll try to
contact them again...
Kind regards

Mentor2 years agoMove around... Have someone in front of you to whom you will tell your worries, and as the discussion goes on, the questions that come to mind will be solved more easily than in writing...
- have a little trust in them...
