Any more disputes possible? (defective item)
Summary: delst111 is having trouble with a purchase of a faulty ignition coil on eBay. The seller is asking for video proof, but does not acknowledge the problem. delst111 wants to open a dispute for a refund without return shipping costs, but can no longer find that option on eBay’s site. The other participants, koalagris, frelonverre, and red71-2011, discuss the possible options and the limitations related to warranties on electronic products. delst111 feels that there is no longer any effective buyer protection and that the situation is not being properly addressed by eBay.
Hello,
Item, an ignition coil, received but defective (no spark), I contacted the seller, who asked me to send him a video of the problem, so I made a video showing that there is no spark at the spark plug, the seller, completely abr...i, replies that he does not sell spark plugs and that he does not see the installed coil (even though you can see it).
So I want to open a dispute for a defective item, but it is IMPOSSIBLE to find anything for that purpose. Before there was "Resolve a problem" as one of the action choices, but it is no longer there.
All the help pages and other topics I could find are no longer up to date (the site no longer matches).
How do I open a dispute?
The only options are The item was not delivered and Return the item.
Except that for Return the item, the return shipping is at the buyer's expense, I would agree if it were a change of mind on my part about the purchase, but here it is an item sold defective, it is not up to me to cover the return costs (especially since the seller must be in China despite eBay, right! : " Item location: FR, France" ...) which will cost more than the item itself.
I don't even see any Dispute Manager at all.
What should I do? Or is it no longer possible and therefore eBay buyer protection no longer exists? (like PayPal, which sides with sellers even with video evidence, of a defective car radio...).
Thanks

don't judge people based on what you can see from their profile
over time I've had many profiles, but on the forum always with profiles reserved for that purpose
delst111
OP1 year agoWell, long story short, sooner or later you’ll have the same problem of having no recourse.

·1 year ago@delst111
when that happens, we'll have the site's instructions and we'll get a refund
but no one will know anything about it
delst111
OP1 year agoYeah, and how? Since there's no more option to open a dispute... Do you need a screenshot to show you? Or rather, show me a screenshot where you still have that option.
Otherwise, zip ...

·1 year ago"Yeah, and how?"
have you tried with please? 🤔
Personally, this is my last intervention on this post.
The link I provided, you click on it, everything is in there.
If you don't do it, that's your choice, just like it was your choice to want to buy a reel at a lower price without an invoice, without a warranty, without a brand, without anything.
Goodbye! 😘
delst111
OP1 year agoMDR Even bought in France with an invoice, there wouldn’t be any more “Open a dispute” button...
Anyway, good luck with that.

I’m sure you can imagine I’m not going to go buy an item just so I can then open a dispute, just to prove to you that you can always make life hard for a seller
so that’s your problem, fig...ure it out yourselves

which will cost more than the item itself.
well then, throw it in the trash and forget about it
delst111
OP1 year agoSo sellers can sell a defective item and not acknowledge it despite video proof, and they should not be sanctioned? So there’s no more protection for buyers 😕 Great.

·1 year agoHello,
So unless I'm mistaken, if the item in question is an electronic component, there’s no warranty, so no exchange possible.
You can buy a diode, a coil, a resistor, but there’s no guarantee it will work.
If you buy a brand-new TV straight from the factory, it comes with the manufacturer’s warranty, which lets you exchange it for another one that works, but you don’t have any warranty on an electronic component that’s part of the whole.
Also, buying from China... well... Even if the origin is marked " France "... Maybe it would have been worth checking the sellers’ names in the legal information. Yes, I know, even I got fooled by it, and it’s regrettable.
A photo or a video is not proof of a malfunction or lack of responsibility.
Nothing proves that you didn’t damage it before assembly, while unpacking it, or simply intentionally to get a refund...
It’s very debatable even with all the honesty and goodwill in the world.
After that, you pay for liability coverage (responsabilité civile) in some insurance policy... if Ebay doesn’t reimburse you, neither does he nor the seller, maybe check with your insurers. It might work.

OP1 year agoHi,
"If the item in question is an electronic item, there is no warranty so no exchange is possible." Where does it say that? Even for non-electronic items, there’s no option to open a dispute either... so it’s off-topic.
This isn’t a TV but an ignition coil (non-removable because it’s molded into the resin), so comparing it to some warranty on a component that’s part of the whole doesn’t make sense, since the coil can’t be opened without being destroyed.
France, China or Mars, it doesn’t matter, if it came from France (sold by a seller who bought it in China) it would be the same: there wouldn’t be any more possibility of opening a dispute (which is what the topic is about, not the coil or where it came from itself). Besides, ebay still isn’t doing anything about these lies about the item’s location...
"A photo or a video is not proof of a malfunction or of non-responsibility." ... so there’s no point in the seller asking for one then?
"Nothing proves you didn’t damage it before installation, while unboxing it, or simply intentionally to get a refund..." what a joke! 😐 If we’re going to go that route, any seller can reply "You’re the one who broke it" for any item... Sure, because all I have to do is waste time and have to order another coil somewhere else... There’s nothing to argue about, the facts are there: there is no buyer protection left anymore, they should remove the mention from their site...
This is going to be a free-for-all of every possible scam from sellers with their thing... great...

we're not going to dwell on this, whether the problem comes from the object or from not knowing how to detect a fault or from an assembly error (a ground not being made between the coil mount and a frame, for example), the site has made its decision so let's move on to something else
delst111
OP1 year agoThe issue isn't the coil itself (not knowing how to detect a breakdown or an assembly error? But lol, 2 screws to fix it onto a motor with a shim for the air gap... ) but the lack of recourse... if they remove the so-called buyer protection then, because that's just plain misleading there...

Well Bob, figure it out yourself.
You're not objective, that's your problem.

OP1 year agoBecause blaming me just because it comes from China and not France, saying that basically I’m the one who broke it, etc etc, is that objective? Oof ...

·1 year agoHello @delst111
"The only options are The item hasn't been delivered and Return the item."
Yes, because defective item = not as described = return request (to be made within 30 days of delivery)
https://www.ebay.fr/help/buying/returns-items-not-received-refunds-buyers/renvoyer-un-objet-pour-obtenir-un-remboursement?id=4041&st=3&pos=1&query=Renvoyer%20un%20objet%20pour%20obtenir%20un%20remboursement&intent=objet%20non%20conforme&lucenceai=lucenceai&docId=HELP1134
If there’s a problem: contact link to customer service at the very bottom of the help page
Best regards

OP1 year agoHello koalagris
Thanks, but in the return form, I can only put one or more photos, visually the item is identical to the one in the listing photos. There is indeed Damaged item received, but same thing, visually the item is not damaged, the fault is electronic. And a return request will be at my expense.
I’ll look into Ask us to call you (well, not easy with not-so-great network coverage and also working irregular hours), but well, I’m not too keen on it (like the Orange "hotline" etc etc that doesn’t understand much).
