Looking for a lawyer in LILLE
Summary: bequet is looking for a lawyer in Lille to take eBay to court, following a dispute involving an allegedly defective product sent to a customer. bequet says they have photo evidence of the product in good condition before shipment, but the customer provided a blurry photo as proof. koalagris suggests challenging the decision through an online resource, while lingma85 advises considering the potential costs of legal action and contacting the FEVAD mediator. ricfel_1920 and Anonymous User warn about the difficulties of such a case, pointing out eBay’s legal resources. felin12 asks questions about the return process and expresses doubts about the effectiveness of legal intervention if the claims process was not followed properly. noctisauxroses mentions that since eBay is only an intermediary, the action could be against the customer rather than eBay.
Hello,
I’m looking for a lawyer in Lille to take Ebay to court
In a few words, I ship a part to a customer who claims to have received a defective product
To support these claims, he sends an unhelpful photo ( a piece of table ? )
I ask for other photos, nothing
Complaint 4 days later and refund
This is the last straw! Where is the protection for sellers?
For your information, I had, unfortunately, to get to this point, taken photos of the product before shipping
This needs to change, I’m sick of being ripped off

·2 years agoEbay is not a sales site, but a matchmaking platform. It’s all in the nuance.
You need to address your customer; you’ve been given their identity by Ebay, and if you need to file a complaint, it’s against them.
What you call seller protection is not insurance in the strict sense of the term, but simply a mediation service that Ebay makes available to you for a fee. If the mediation doesn’t succeed, Ebay is not responsible 😉

@bequet
For an item not as described dispute, normally there is a return request. Has that been done?
If no response to the dispute was submitted on time, Ebay refunds the buyer and they keep the item.
If that's the case, I'm not sure a lawyer could do anything
kind regards

No matter the amount of your transaction, be wise and take a calculator to figure out whether going to a lawyer wouldn’t be too expensive, even just for a consultation.
The "game has to be worth the candle", otherwise.... you swallow your disappointment to make your wallet happy.
See the FEVAD mediator first...
Best regards

·2 years agoGoing after a monster like ebay is going to cost you dearly for a result that is absolutely not guaranteed, especially since ebay must have a very combative legal department. On top of that, there are the Terms of Use that many people don't read all the way through.
Good luck and keep us informed about how the proceedings are going.

OP2 years agoI "disputed" it, but mainly formally demanded that Ebay send me the photo sent by the customer
since it no longer appears in the dispute file..........

·2 years agoHello @bequet
Did you challenge the site’s decision following the dispute?
