Dispute - how do I get my product back?
Summary: thesouleater is dealing with a dispute issue on eBay where the buyer initiated a chargeback after receiving a video game, leaving thesouleater with neither compensation nor the product returned. Advice is offered by lingma85, suggesting sending the buyer a registered letter to get the game back, and, if that fails, filing a complaint. thesouleater is worried about a possible scam and is considering legal action while looking for a solution that would avoid additional costs.
Hello,
having used Ebay for years as both a buyer and a seller, today I am facing a dispute situation for the first time. On the site everything is clearly explained regarding the procedure to follow, but in my case, I can't find the solution.
I'll briefly explain:
- I sold a video game that worked very well but apparently not for my buyer
- he opened a dispute so I became aware of the problem
- no problem, I sent him a message to tell him that I agreed to take the game back and that I was going to create a return label at my expense so he could send it back to me
- According to Ebay's site, the procedure is simple: go to the order details, "View return details" and then upload the label and the various contact details. The problem is that when I go to the "View return details" section, I get this message:
"This return request is closed
On Sept. 20, this return request was closed.
We were informed that the buyer had requested a reversal of the charge from their card issuer, bank, or another payment institution. You do not need to do anything. "
From there I can't do anything anymore so if I understand correctly the buyer refused the payment but there is no longer any tracking regarding the return of the item 🤔 ???
For now the buyer is no longer replying to me.
In your opinion, how should I proceed to get my item back?
Thank you for your help!

·1 year agoHello @thesouleater
Chargeback...???
Apparently eBay is letting you down because your buyer’s bank accepted the chargeback... but since he has the item... there would therefore be fraud on his part, (but difficult to prove without an investigation or legal proceedings)...
Still, try this-------->
- since you shipped the item, you know your buyer’s address...
Write him a registered letter with acknowledgement of receipt asking him to return the video game to you within a time frame that you set...
If he doesn’t respond and/or doesn’t send the item back, tell him you will file a complaint with the local court, which has jurisdiction in this matter...
This may get him moving, because it’s always unpleasant to have this kind of procedure...
Put together a file with all the evidence or information you have in your possession (scans or a copy of the listing + various messages if there are any + a copy of the dispute with eBay’s response for its closure...)
(of course, this comes with no guarantee of success on my part....)
Best regards

OP1 year agoThe more I read the articles about scams on Ebay, the more I realize that I may actually be the victim of a scam.
In fact, Ebay is absolutely not secure for sellers!!!
It’s too easy, when the funds were blocked by Paypal until September 29 anyway. Logically, the payment rejection should be done once we’ve actually recovered our product; this is nothing more or less than encouraging theft!
Thank you for your message. However, taking this matter to court is likely to cost me money, I’d like to avoid that, it’s not the right time 😞
I have his address and phone number. And he doesn’t live very far away, so we’ll see ...

The procedure is free if you do not use the help of a lawyer... and on the other hand, you can request legal aid if your income does not allow you to defend yourself normally.
On the other hand, don’t forget that eBay is a platform connecting buyers and sellers...
It is not supposed to act as a police officer or judge and is also a “victim” of all kinds of scammers since this takes away its earnings (% on sales) when there is a dispute..
